The property contained a fabrication plant that had experienced a release of chlorinated solvents into soil that migrated into the underlying groundwater in the 1990s. The site was entered into the Texas Voluntary Cleanup Program (VCP) in 1999 and extensive groundwater investigations were undertaken. The groundwater plume was defined to be located entirely on the Site and its stability had been established by over a decade of groundwater monitoring. Although no impacts to area water wells were identified, the concentrations exceeded default cleanup criteria established by TCEQ for Class 1 groundwater. Since all other exposure pathways had been addressed, a restriction on groundwater use was sought using the MSD process. VCP Closure in Grapevine Using MSD Process

A private client of W&M received certification from the Texas Commission on Environmental Quality (TCEQ) for a Municipal Setting Designation (MSD) to restrict groundwater use at a retail property located in Grapevine, TX. W&M worked with a local real estate developer, John T. Evans and attorney, C. Bishop Law to cleanup and close a contaminated property in Grapevine, Texas. The Site was contaminated with volatile organic compounds (VOCs) including several chlorinated compounds in the groundwater and to a lesser extent soil.
